These terms govern your use of this site and any purchase you make from it. The contracting party is Mazalito NYC LLC, a New York limited liability company with its registered address at 76 W 47th Street, New York, NY 10036, trading as Mazalito ("Mazalito", "we", "us", "our").
By using the site or placing an order you agree to these terms. If you do not agree to them, do not use the site.
1. Who can buy
You must be at least 18 and legally able to enter a contract. If you are under 18 you may use the site only with a parent or guardian involved. We do not knowingly collect information from anyone under 13; if you believe we have, email privacy@mazalitonyc.com and we will delete it.
2. Product descriptions, origin, and disclosure
We sell both laboratory-grown and natural stones, side by side. Which one you are looking at is stated in the product title or the first line of the description on every page. It is never hidden in a spec table and it is never left to inference.
- A laboratory-grown stone is described as laboratory-grown or laboratory-created. We do not describe it as real, genuine, natural, or precious, because it is not, and because saying so would be unlawful.
- Any treatment that is not permanent, requires special care, or affects value is disclosed on the product page.
- Where a stone carries a grading report, the report number is on the page. Where we describe a stone as certified, there is a report number on file. Where there is no report, we say so.
- Gram weights, dimensions, and metal purity are stated as measured. We do not estimate a spec.
These disclosures follow the Federal Trade Commission's Guides for the Jewelry, Precious Metals, and Pewter Industries, 16 CFR Part 23.
We make no claim about resale value, investment return, or future appreciation, and nothing on this site should be read as one. Jewelry and watches are goods, not securities. If any employee, affiliate, or content on this site suggests otherwise, that statement is unauthorized and does not bind us.
Photography is taken of the actual piece wherever the piece is unique. Stock line items are photographed as a representative example of that model. Screens vary; color and scale on your monitor are not a warranty.
3. Pre-owned watches — independent dealer
Mazalito is an independent dealer. We are not an authorized dealer for, and are not affiliated with, sponsored by, or endorsed by, Rolex, Audemars Piguet, Patek Philippe, Cartier, or any other watch manufacturer. All trademarks and brand names are the property of their respective owners and are used only to identify the goods offered.
Pre-owned watches are sold as described on their product page, including condition, service history where known, and which components are original to the watch. A manufacturer's warranty does not transfer to you through us. Any warranty on a pre-owned watch is the one stated on the product page and offered by us, not by the manufacturer.
Where a watch has been customized or fitted with parts not supplied by the manufacturer, that is stated plainly on the product page. A customized watch is not covered by the manufacturer's warranty and may not be serviceable at the manufacturer's service centers.
4. Pricing
Prices are in U.S. dollars and are subject to change without notice. Gold-weight items are priced against the market and can move.
We try to get every price right and occasionally we do not. Where a piece is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfill it. We will tell you before we do, and you are free to reorder at the correct price or not.
Prices exclude sales tax, which is calculated at checkout, and exclude any duties on international orders.
5. Orders
Your order is an offer to buy. It is accepted when we ship, not when you click. We may decline or limit an order — for example where a piece is out of stock, where the order fails our verification checks, or where we suspect fraud.
Every order is subject to identity and payment verification before it ships. On higher-value orders that may mean we contact you. This is not optional and it exists to protect you as much as us.
6. Custom projects
Custom work runs on a separate agreement: we scope the piece, you approve a design, you pay a deposit, and production begins. The deposit is non-refundable once production begins, because at that point the metal has been purchased and the bench time booked. Approvals happen at defined checkpoints and we do not proceed past one without yours.
Lead times given for custom work are estimates made in good faith. Stone sourcing and bench capacity can move them. We will tell you when they move.
7. Shipping and risk
Shipping timelines are stated on the product page and at checkout. Risk of loss passes to you on delivery to the address you gave us, not on dispatch — but only where the parcel was shipped insured through our account and signed for. Where you direct us to leave a parcel without a signature, or you redirect it in transit, that risk becomes yours.
Check the address before you submit. We are not responsible for a parcel delivered correctly to an address you typed incorrectly.
8. Returns
Governed by our Returns and Refunds policy, which forms part of these terms.
9. Appointments and the showroom
Appointments are a courtesy and are not a contract to sell at any particular price. Pieces shown in the showroom may also be listed online and may sell before your appointment.
10. Your content
If you send us reviews, photographs, or other material, you grant us a non-exclusive, royalty-free license to use it in connection with our business, and you confirm you have the right to grant that. We are not obliged to publish or keep anything you send. Do not send us anything confidential.
11. Our content
The text, photography, and design on this site belong to us or our licensors. You may not scrape, republish, or use them commercially without written permission. Product photography in particular is ours; it is one of the few things a jeweler genuinely owns.
12. Acceptable use
Do not use the site to break the law, infringe anyone's rights, transmit malware, scrape at volume, interfere with its operation, or attempt to gain access you were not granted. We may suspend access for any of these.
13. Third-party links and services
The site links to and relies on third parties — payment processors, shipping carriers, financing providers, design tools. Their terms govern their services. We are not responsible for their content or conduct.
14. Disclaimer of warranties
The site is provided "as is". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement in relation to the site itself.
This does not limit your rights in the goods you buy. Products sold are covered by the warranty stated in our Returns and Refunds policy and by any rights you have under applicable consumer protection law, which we do not attempt to exclude.
15. Limitation of liability
To the fullest extent permitted by law, Mazalito NYC LLC, its officers, employees, and agents are not liable for indirect, incidental, special, or consequential damages arising from your use of the site.
Our total liability arising from any order is limited to the amount you paid for that order.
Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify Mazalito NYC LLC against claims arising from your breach of these terms or your misuse of the site, to the extent permitted by applicable law. This does not extend to matters arising from our own negligence or breach.
17. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes are subject to the courts of New York County, New York.
These terms do not contain a binding-arbitration clause or class-action waiver.
18. Severability and entire agreement
If any provision is found unenforceable, the rest stands. These terms, together with our Privacy Policy and Returns and Refunds policy, are the entire agreement between us on this subject.
19. Changes
We may update these terms. The version that applies to your order is the version live when you placed it. Material changes will be posted here with a new date at the top.
20. Text messages (SMS)
If you give us your mobile number and consent to texts, this section applies. It covers the Mazalito text-message program, run by Mazalito NYC LLC.
What you are agreeing to. You agree to receive recurring automated text messages from Mazalito at the number you provided, even if that number is on a state or federal Do Not Call list. Service messages cover things like order updates and account alerts. Marketing messages cover offers, new pieces, and reminders about a cart you left behind.
Consent is not a condition of purchase. You can buy from us without signing up for texts.
Cost and frequency. We do not charge for the program. Your carrier's message and data rates may apply, and you are responsible for them. Message frequency varies.
Opting out. Reply STOP to any message, or use the unsubscribe link where one is provided, and you will get one confirmation text and nothing further unless you sign up again. If you are enrolled in more than one Mazalito text program, opt out of each one separately.
Help. Reply HELP to any message, or email hello@mazalitonyc.com.
Numbers can change. We may change the phone number or short code we send from and will let you know when we do. A STOP or HELP sent to a number we no longer use may not reach us.
Delivery. Carriers are not liable for delayed or undelivered messages, and to the extent the law allows, neither are we. Give us a working mobile number; if you change numbers, sign up again with the new one.
